Welcome to MYTPTD! These Terms of Use ("Terms") govern your use of the BSMART Solutions mobile application (the "App") and any related services provided through our website, mytptd.com (collectively, the "Service"). The Service is owned and operated by BSMART Solutions ("we," "us," or "our").

Please read these Terms carefully. By creating an account or by accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

BSMART Solutions provides a digital platform for active personnel of the Karnataka Education Department to create, maintain, and manage their official tour plans and tour diaries paperlessly ("User Content"). The Service is designed to reduce administrative workload and help users focus on their core responsibilities.

2. Eligibility and User Accounts

Eligibility

Use of the Service is strictly limited to active and verified personnel of the Karnataka Education Department (including CRPs, BRPs, ECOs, BIERTs, BRCs, BEOs).

Account Creation

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

Verification

We require a verification process before activating an account to ensure users meet the eligibility criteria. We reserve the right to refuse or terminate an account if eligibility cannot be confirmed.

Account Responsibility

You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately at admin@mytptd.com of any unauthorized use of your account.

3. User-Generated Content and Data Ownership

Data Ownership: You retain full ownership of the intellectual property and all other rights to the User Content you create within the Service, including your tour diaries and tour plans.

License to Us: By using the Service, you grant BSMART Solutions a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content for the sole purpose of providing and improving the Service for you.

4. Privacy and Data Security

Your privacy is important to us. We are committed to protecting the security of your data and use industry-standard technical and organizational measures to safeguard your User Content.

We will not share your personal data or User Content with any third party without your explicit consent, with one exception: if and when paid services are introduced, we may share limited, necessary information (such as your name or email) with our designated payment processing partners for the sole purpose of processing payments.

5. Service Fees and Modifications

Current Status: The Service is currently provided free of charge.

Future Changes: BSMART Solutions reserves the right to introduce service fees in the future, such as subscription charges. We also reserve the right to end our free service at any time and transition to a paid model. Users will be notified in advance of any such changes.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any purpose other than its intended official use.
• Sharing your account credentials with any other person.
• Attempting to decompile, reverse engineer, or otherwise attempt to discover the source code of the App.
• Using the Service to transmit any viruses, worms, or malicious content.
• Violating any applicable state or national law.

7. Termination

Termination by Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if:

• You breach any of these Terms.
• You are no longer an active and verified member of the Karnataka Education Department.
• We decide to discontinue the free service or the service altogether.

Termination by You: You can stop using the Service and request the deletion of your account at any time by contacting us.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. BSMART Solutions makes no warranties, express or implied, that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, BSMART Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in Kalaburagi, Karnataka, India.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email, providing a notice through the App, or updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after any modification constitutes your acceptance of the new Terms.
